4. Intellectual Property

PatentabilityScore and all related content, features, and functionality (including but not limited to software, algorithms, UI/UX, text, graphics, logos, and trademarks) are owned by us or our licensors and are protected by copyright, trademark, patent, and other intellectual property laws.

4.2 Your Content

You retain all rights to the patent descriptions, technical specifications, and other content you submit to our platform ("Your Content"). By using our services, you grant us a limited license to:

• Process Your Content to provide our analysis services
• Store Your Content on our secure servers
• Use anonymized and aggregated data from Your Content to improve our AI models
• Display Your Content back to you in reports and analysis results

This license terminates when you delete Your Content from our platform, except for anonymized data used in aggregate for model training.

4.3 Confidentiality

We understand that your patent ideas are confidential and valuable. We will not disclose Your Content to third parties except as necessary to provide our services (e.g., accessing patent databases) or as required by law. See our Privacy Policy for more details.

5. Limitation of Liability and Disclaimers

5.1 Service "As Is"

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

PatentabilityScore is an analysis tool, not a substitute for professional legal advice. Our AI-generated analyses and scores are informational only and should not be relied upon as legal opinions or patent prosecution guidance. You should consult with a qualified patent attorney for legal advice regarding your specific situation.

5.3 Accuracy Disclaimer

While we strive for accuracy, we do not guarantee that our analysis results are error-free, complete, or current. Patent analysis involves complex legal and technical assessments, and AI-generated results may contain inaccuracies or miss relevant prior art.

5.4 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Costs of obtaining substitute services
• Patent application rejections or lost patent rights
• Decisions made based on our analysis results

Our total liability to you for all claims arising from your use of our services shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

5.5 Service Availability

We do not guarantee that our service will be uninterrupted, timely, secure, or error-free. We may experience downtime for maintenance, updates, or due to factors beyond our control. We are not responsible for any loss or damage resulting from service interruptions.

6. Termination

6.1 Termination by You

You may terminate your account at any time by canceling your subscription through your account settings or by contacting our support team. Upon termination, you will lose access to your data and analysis results.
